Terms & Conditions

In making bookings clients accept the ‘Terms and Conditions’ and ‘Bookings and Cancellation’ Policy as laid out below

THE CONTRACT

1.1 The Terms and Conditions set out here, together with the order confirmation from a quotation comprise your agreement with TL Training Ltd and agreement has been confirmed in writing.

THE COURSE AND OUR OBLIGATIONS

2.1         TL Training agrees to provide you with the training course as indicated on the order confirmation. Onsite course means any course running at a client’s or client’s designated premises.

2.2         TL Training courses or learning events includes all necessary tuition and supervision for you to complete the course and obtain the relevant course qualification provided you attend the course without interruption and achieve the required competence. Specific Conditions relating to certain courses including, without limitation, terms and conditions concerning prior qualification requirements, identity checks, conditions laid down by qualification awarding bodies and warranties.

2.3         Where TL Training has arranged external examinations for the client the company accepts no liability for the accuracy of the client details should a dispute arise with the external examination body

2.4         Every effort is made to ensure course notes, presentations and any replacement tuition material is correct at the time of print. The company accepts no responsibility for any errors or omissions

CANCELLATION AND ALTERATION BY TL TRAINING

3.1         Sometimes we may need to cancel or reschedule your course with little or no notice. We reserve the right to make changes after we have entered into the contract.  However, if we must make major changes to the course you have booked; which includes change of venue, or certifying body or significant change in the duration or date of commencement, you have the following options;

3.1.1      Accept the new course, venue, or date offered by us, or

3.1.2      Cancel your course and receive a full refund of all monies paid for the course only; we are not liable for any additional costs incurred if you have booked accommodation, travel or leave from work

3.1.3      You must notify us by email or telephone within five days of our offer of an alternative course and if you do not, we will take it as your acceptance of the alternative course

3.1.4      TL Training reserves the right to make amendments to the published programme, where changes are necessitated by factors beyond our control

3.1.5      TL Training and its training suppliers may also vary the course modules from time to time to take account of new regulations or requirements of certifying bodies

3.1.6      We will notify you only if the change is material, or constitutes a major change as above, if there is an additional cost you agree to be liable for this cost

EVENTS OUTSIDE OF OUR CONTROL

4.1         TL Training will not be responsible for any failure to perform, or delay in performance of, any of our  obligations under these conditions that is caused by an event outside of our control. An event outside of our control means any act or event beyond our reasonable control, including without limitation:

4.1.1      Failure of the Department of Transport or such other appropriate agency/accrediting body to provide an examiner for any reason

4.1.2      Strikes, lock outs or other industrial disputes (whether involving the workforce supplier or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, damage, compliance with any law or governmental order or rule. Regulation or direction, accident, breakdown of machinery, fire, flood, storm or default of suppliers or sub-contractors.

CANCELLATION BY YOU

5.1         All cancellations must be made in writing by either letter or e mail prior to the commencement date of the course

5.2         Cancellation fees for training courses or places cancelled for whatever reason will incur the following  charges:

5.3         In the event of non-attendance NO refund will be given for whatever reason

5.4         Bookings made less than 21 days prior to course commencement will still incur cancellation fees (see 5.2) even if payment has not yet been received, i.e. BACS, cheque or any other payment

RESCHEDULING BY YOU

6.1         Once a course, a training day or training day within a program is booked, rescheduling may incur cancellation fees as per table 5.2 if less than 21 days prior to start date.  TL Training will endeavour to accommodate the request subject to availability

PAYMENT

8.1 All fees will be clearly outlined during the booking process

8.2 No booking is confirmed until receipt by TL Training of a company Purchase Order (where required by the client) for the quoted course and confirmation by TL Training of availability, unless otherwise authorised.  Company Purchase Order numbers when required to be quoted on invoices, must be confirmed for bookings to be placed, unless otherwise authorised by TL Training in writing

8.3 Places on courses and dates requested on enquiry cannot be held until such time as payment has been received by TL Training

8.4 Any online bookings are only confirmed upon receipt of the e mail order confirmation which will be sent by TL Training to the client

8.5 Where the client chooses to pay by BACS, payment is required to clear TL Training’s bank account within 3 working days

CANDIDATES

  • •  Documentation must be provided to confirm the identity of candidates. TL Training are also required by our accrediting bodies to sight evidence of previous training where applicable
  • • Candidates attending forklift courses are required to be reasonably fit, both physically and mentally, to safely control and operate lift trucks, with the learning ability and potential to become competent operators (Guidance can be obtained from the Health and Safety Executive’s publication HSG6 ‘ Safety in Working with Lift Trucks’)
  • •  Candidates will not be authorised to sit the course should they not meet the prerequisites of the course, this includes, but is not limited to, speaking, writing and understanding English, age restrictions and holding the correct certificates
  • •  No bad language or disruptive, threatening or violent behaviour will be tolerated against any employee of TL Training, its associates or any other candidate. A breach of this provision may result in your immediate removal from the course without reimbursement
  • •  Use of alcohol and/or drugs in not permitted anywhere on TL Training premises
  • •  Candidates should arrive at the training venue 10 minutes before the start of the course; late arrivals are permitted at the discretion of TL Training and/or the Trainer. Candidates who arrive late and are not permitted to attend the course will still be required to pay in full or will not be eligible for a refund or credit note
  • •  The requirements will be supplied to the client prior to the course start to ensure they have full information as to the requirements
  • •  Candidates attending forklift courses at our Bromborough training centre are advised, during Winter months, to wear warm layered clothing due to low temperatures in the warehouse training area

CANDIDATE NAME CHANGES

10.1       In the event of a candidate name change for any reason there will be and administration charge of £5.00 + VAT per candidate.  Please note it is the responsibility of the client to make sure the name of the candidate(s) is correct

TRAINING ON CLIENT’S PREMISES

11.1 The client will provide suitable premises or site for the course to be carried out in a safe manner

11.2 TL Training has the right to reject equipment, materials or training area if they are considered unsatisfactory in view of safety

11.3 The client will provide adequate quantities of materials and tools for the persons attending the training course

RESOURCES FOR CLASSROOM-BASED TRAINING ON CLIENT’S PREMISES

12.1 To provide effective training on your premises our instructor must have access to specific documentation, literature, equipment and adequate facilities:

  • •  A room or rooms suitable for ‘Theoretical & Audio-Visual’ presentations, practical demonstrations and free from distractions
  • •  Access to WIFI where possible
  • •  Emergency exits clearly marked in accordance with The Health & Safety (Safety Signs and Signals) Regulations 1996
  • •  Safe Systems of Operations & Risk Assessments
  • •  An adequate supply of tables and chairs for use by the candidates and the Instructor

RESOURCES FOR FORKLIFT TRUCK TRAINING ON CLIENT’S PREMISES

13.1 To provide effective training on your premises our instructor must have access to specific documentation, literature, equipment and adequate facilities:

  • •  Employers ‘Authorisation to Operate; (Blank form provided by TL instructor)
  • •  Access to WIFI where possible
  • •  Safe Systems of Operations & Risk Assessments
  • •  Lift Truck is in a safe mechanical condition, available for the full uninterrupted duration of the course
  • •  A copy of the current ‘Report of Thorough Examination’ (LOLER 98) for the ‘Lifting Chains’ and ‘Lift Truck’ (specific to the Lift Truck allocated for the training course)
  • •  Lift truck Manufacturers Safe Operating handbook (specific to the Lift Truck allocated for the training course)
  • •  A ‘Practical Manoeuvring Area ‘away from normal operational areas (preferably undercover, but not essential) measuring approximately 12m x 6m. A larger area will be required for a larger Lift Truck
  • •  A supply of empty pallets, realistic stackable loads and where applicable access to your industrial racking system and vehicle loading facilities
  • •  The industrial racking system must comply with the guidance given in Storage and Equipment Manufacturers Associations (SEMA) Code of Practice
  • •  Access to Lift truck refuelling Area together with appropriate resources and PPE
  • •  A room or rooms suitable for ‘Theoretical & Audio-Visual’ presentations, practical demonstrations and free from distractions.
  • •  Emergency exits clearly marked in accordance with The Health & Safety (Safety Signs and Signals) Regulations 1996
  • •  An adequate supply of tables and chairs for use by the candidates and the Instructor.
  • •  A Risk Assessment will need to be undertaken pertaining to the areas selected for the provision of training

If you are unsure about the suitability of your premises for training, a TL Training instructor can carry out a ‘Training Location Assessment’ at your convenience.  Please note there will be a charge for this service

Should you require confirmation that you site is suitable for training to take place, a TL Training instructor can undertake

OUR LIABILITY TO YOU

14.1       We accept no responsibility if you suffer death or injury while on a course

14.2       We cannot accept responsibility for any consequential or indirect loss you suffer, even as a result of           a breach of duty on our part in contract or tort

14.3       TL Training Ltd does not accept any liability whatsoever for loss or damage incurred during a course of tuition to the client or any 3rd party goods, equipment, lift trucks, MHE, buildings, materials or chattels

COMPLAINTS

15.1       If a problem or issue arises whilst you are on your course, you must raise it with the instructor of TL Training immediately on the day of training and every effort will be made to address this in a timely manner. If you fail to notify us of your complaint while on the course TL Training will be unable to rectify the problem.  This is in line with TL Training’s Complaints Policy which is available upon request

PRIVACY
